This “Privacy Notice” (“Notice”) describes the privacy practices of NOTA Collective, Inc. and our subsidiaries and affiliates (collectively, “NOTA”, “we”, “us”, or “our”) in connection with the www.heynota.com website (the “Site”), and any other website that we own or control. It describes how we protect your personal information when you use or access the Site, as well as the privacy rights that you may have under the European Union’s (“EU”) General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act of 2018 (“CCPA”).

While we mainly use the term “personal information” in this Notice, it means the same thing as “personal data”: any information relating to an identified or identifiable individual.

This Notice describes the types of personal information collected and created in connection with your use or access to the Site, how and why we use such information, who we share it with, and your legal rights. In the context of this Notice, for the purpose of the GDPR, we are the controller of your personal information.

We collect a variety of information from you when you provide it to us directly, when we request it from you, or when you give us permission to get it from a third-party source. The CCPA requires us to categorize the personal information that we collect, process, or store about you over the past twelve months and how we obtained such personal information, which is set out below:

Identifiers (such as a real name, alias, zip code, device identifiers, advertising identifiers, Internet Protocol address, email address, account name, or other similar identifiers):

  • When you sign up for a Member account, you provide your email address and name.
  • When you interact with our customer support, you provide your email address, name, as well as any other information you decide to share with us.
  • When you sign up to receive our newsletter, you provide your email address and name.
  • When you visit or interact with our pages on social media platforms, such as Facebook, LinkedIn, Twitter, Instagram, and other third-party platforms, you are agreeing to the platform provider’s privacy notice, and this may include sharing with us your name.
  • Data from other accounts. If you use a third party, like Google, to log in to the Site (or later connect your third-party account to your NOTA account), then you authorize the third party to share your personal information with us, including your name, username, email address, and any other information you agree to share. The platform provider’s privacy notice applies to your interactions and their collection, use and processing of your personal information.
  • Information from Third Parties. We may receive this category of personal information about you from third-party sources. For example, we may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.

 

Protected Characteristics (age, race, ancestry, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression or sexual orientation), pregnancy or childbirth and related medical conditions):

  • When you interact with our customer support, you may provide this information that you decide to share with us.
  • When you visit or interact with our pages on social media platforms, such as Facebook, LinkedIn, Twitter, Instagram, and other third-party platforms, you are agreeing to the platform provider’s privacy notice, and you may share these protected characteristics with us.
  • From other accounts. If you use a third party, like Google, to log in to the Site (or later connect your third-party account to your NOTA account), then you authorize the third party to share your personal information with us, including your disclosure of protected characteristics.
  • From Third Parties. We may receive this category of personal information about you from third-party sources. For example, we may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.

 

Sensory Information (images and audio):

  • When you sign up for a Member Account. You may provide us with a profile picture.
  • When you interact with our pages on social media platforms such as Facebook, LinkedIn, Twitter, Instagram, and other third-party platforms, you may provide us with your profile picture and other images and/or audio clips that you choose to upload.
  • Data from other accounts. If you use a third party, like Google, to log in to the Site (or later connect your third-party account to your NOTA account), then you authorize the third party to share your personal information with us, including your profile photo.

 

Financial Information (credit card information):

  • When you sign up for a Member Account. You may provide us with your credit card and other financial information.

 

Commercial Information (membership information and information about your transactions with us):

  • When you sign up for a Member Account. You may provide us with commercial information.
  • When you interact with our customer support, you may provide other commercial  information you decide to share with us.
  • From Third Parties. We may receive this category of personal information about you from third party sources. For example, we may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.

 

Internet or Other Similar Network Activity (information on a consumer’s interaction with a website, application, or advertisement):

  • From Third Parties. We may receive this category of personal information about you from third-party sources. For example, we may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.
  • Collected by automated means from your browser and device through cookies and other tracking technologies. With your permission where it is required by applicable laws, we, our service providers, and our business partners may automatically log information about you, your browser, your computer or mobile device, and your activity on the Site. The information that may be collected automatically includes your computer or mobile device operating system type and version number, manufacturer and model, device identifier (such as the Google Advertising ID or Apple ID for Advertising), browser type, screen resolution, IP address, the website you visited before browsing to our website, general location information such as city, state or geographic area; and information about your use of and actions on the Site, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and length of access.

 

Geolocation Date (physical location):

  • When you interact with our customer support, you may provide this information that you decide to share with us.
  • Information from Third Parties. We may receive this category of personal information about you from third-party sources. For example, we may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.
  • Collected by automated means from your browser and device through cookies and other tracking technologies. With your permission where it is required by applicable laws, we, our service providers, and our business partners may automatically log information about you, your browser, your computer or mobile device, and your activity on the Site. The information may include general location information such as city, state or geographic area.

 

Inferences:

  • Inferences may be derived: from general geographic data, information about your interaction with our Site, information about your interaction with advertisements, information about your communications with us, and information from your activities on the Site.

We must have a valid reason to use your personal information. This is called the “lawful basis for processing”. Our legal bases for processing the personal information described in this Notice are described below.

Performance of a contract.

We process your personal information as is necessary to provide the services that you requested from us, as described in our Terms of Use or other applicable agreement. For example:

  • We use your information in order to create your account and set you up as a member on NOTA.
  • We share your information with a services provider to provide you with the services you requested.

 

Where we receive your personal information as part of providing our services to you to fulfill a contract, we require such personal information to be able to carry out the contract. Without that necessary personal information, we will not be able to provide the services to you.

Your Consent.

We process certain information based on your consent, which you may revoke at any time. For example:

  • We and our partners use cookies and similar technologies, as described in more detail in our Cookie Policy, based on your consent.
  • We and our partners rely on your consent to provide you with tailored ads based on your actions and information, including based your activity on the Site and other websites.
  • We will send you marketing communications where you have consented to receiving such communications in accordance with applicable law.

 

Where we process your personal information based on your consent, you may withdraw it at any time. However, this will not affect the lawfulness of our processing before you withdrew your consent. It will also not affect the validity of our processing of personal information performed on other lawful grounds.

Legitimate Interests.

We may process your personal information where it is necessary for the purposes of our legitimate interests or our partners’ legitimate interests. In particular, we process your personal information in furtherance of the following legitimate interests:

  • Keeping the services safe and secure: We and our service providers use your personal information because it is necessary to pursue our legitimate interests in ensuring our Site is secure, such as implementing and enhancing security measures and protections, protecting against fraud, spam and abuse, and enforcing our Terms of Use.
  • Providing, improving, and developing the services: We and our service providers use your personal information to provide the Site as well our products and services, including any personalized services, and to understand and improve our business. We do so as it is necessary to pursue our legitimate interests of providing an innovative and tailored offering to our users and members on a sustained basis.
  • Providing ads, and measurement and analytics services: We and our partners use your personal information to provide personalized ads, and to measure and analyze the success of those ads in order to provide accurate and reliable reporting to our advertisers. We do so as necessary to pursue our legitimate interests and our partners’ legitimate interests of marketing and monetizing our services.

Where we process your information based on legitimate interests, you have the right to object to such processing. When you exercise your right to object, we will cease processing your personal information for that specific purpose, unless there are compelling legitimate grounds overriding your objection or where your information is processed for legal reasons.

Legal Obligation.

We may process your information in order to comply with a legal obligation, a court order, or to exercise and defend legal claims. For example:

  • We may preserve and disclose your information if it is necessary to respond, based on applicable law, to a valid legal request (e.g., a subpoena, search warrant, court order, or other binding request from government or law enforcement).
  • We may retain and process your information where it is necessary for compliance with applicable laws.

We use your personal information for the following purposes and as otherwise described in this Notice or at the time of collection:

To provide our products and services, and operate the Site.

We use your personal information to:

  • Provide, operate and improve the Site, and our products and services.
  • Establish and maintain your user profile on the Site.

We use your personal information to register your participation in the events and contests that we organize, and to send you updates about such events and contests.

We analyze use of the Site to improve the Site and to develop new products and services, including studying user demographics and use of the Site.

To send you marketing and promotional communications.

With your consent where required by applicable laws, we may send you NOTA-related marketing communications. You will have the ability to opt out of our marketing and promotional communications at any time as described below in the “Cookies, Marketing, and Targeted Online Advertising” section.

To display advertisements.

We work with advertising partners to display advertisements elsewhere online. These advertisements may be targeted based on your use of the Site or your activity elsewhere online. For compliance, fraud prevention, and safety.

We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the Terms of Use that govern the Site; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

To create anonymous, aggregated or de-identified data.

We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Site and promote our business, as allowed by applicable law.

To comply with law.

We use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

Use for new purposes.

We may use your personal information for reasons not described in this Notice where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the personal information we have collected about you, we will either delete or irreversibly anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. If we anonymize your personal information (so that it can no longer be associated with you), we may use this information indefinitely without further notice to you.

The following section describes how, in the last twelve months, the categories of information we have disclosed to third parties for business purposes and the categories of those third parties. It also describes the categories of information we sell to third parties, and the categories of those third parties.

  • This category of personal information is sold to service providers such as advertising partners, in order to facilitate online advertising.

 

Geolocation Date:

  • This category of personal information is disclosed to our affiliates, partners, and service providers such as our advertising partners.
  • This category of personal information is sold to service providers such as advertising partners, in order to facilitate online advertising.

 

Inferences:

  • This category of personal information is disclosed to our affiliates, partners, and service providers such as our advertising partners.
  • This category of personal information is sold to service providers such as advertising partners, in order to facilitate online advertising.

All of the above categories of personal information may be provided to our professional advisors where necessary in the course of the professional services that they render to us; authorities and others for compliance, fraud prevention and safety; and our business transferees when we may sell, transfer or otherwise share some or all of our business or assets.

Cross Border Transfers.

We are headquartered in the United States and have service providers in other countries, and your personal information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those in your state, province, or country. However, when the personal information is protected by the GDPR, before transferring your personal information to these third parties, we will either ask for your explicit consent or require the third party to maintain at least the same level of privacy and security for your personal information that we do.

If we transfer your personal information outside of respectively the EU or the United Kingdom (“UK”) to a country not deemed by the European Commission or the UK Government (as and where applicable) to provide an adequate level of personal information protection, we will take measures to protect your personal information as described in this Notice and in compliance with applicable laws and regulations. We also require all third parties with whom we share your personal information to process your information in a secure manner and in accordance with the GDPR and other applicable data privacy laws (e.g., through the signing of the EU Standard Contractual Clauses).

In this section, we describe the specific rights under the GDPR and CCPA regarding your personal information that we collect and process. Please note that you can only exercise these rights with respect to personal information that we process about you when we act as a data controller or as a “business” under the CCPA. In this section, we first describe these rights, then we explain how you can exercise these rights.

Right to Know What Happens to Your Personal Information.

This is called the right to be informed. It means that you have the right to obtain from us all information regarding our data processing activities that concern you, such as how we collect and use your personal information, how long we will keep it, and who it will be shared with, among other things. We are informing you of how we process your personal information with this Notice.

Right to Know What Personal Information We Have About You.

This is called the right of access. This right allows you to ask for full details of the personal information we hold on you. You have the right to obtain from us, including confirmation of whether or not we process personal information concerning you, and, where that is the case, a copy or access to the personal information and certain related information.

Once we receive and confirm that the request came from you or your authorized agent, we will disclose to you:

  • The categories of your personal information that we process;
  • The categories of sources for your personal information;
  • Our purposes for processing your personal information;
  • Where possible, the retention period for your personal information, or, if not possible, the criteria used to determine the retention period;
  • The categories of third parties with whom we share your personal information;
  • If we carry out automated decision-making, including profiling, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you;
  • The specific pieces of personal information we process about you in an easily-sharable format;
  • If we sold or disclosed your personal information for a business purpose, the categories of personal information and categories of recipients of that personal information for both sale and disclosure;
  • If we rely on legitimate interests as a lawful basis to process your personal information, the specific legitimate interests; and
  • The appropriate safeguards used to transfer personal information from the EU / European Economic Area (“EEA”) or the UK to a third country, if applicable.

 

Under some circumstances, we may deny your access request. In that event, we will respond to you with the reason for the denial.

The CCPA, if applicable, does not allow us to disclose Social Security numbers, driver’s license numbers or other government-issued identification numbers, financial account numbers, any health insurance or medical identification numbers, account passwords, or security questions and answers. We can inform you that we have this information generally, but we may not provide the specific numbers, passwords etc. to you for security and legal reasons.

Right to Change Your Personal Information.

This is called the right to rectification. It gives you the right to ask us to correct without undue delay anything that you think is wrong with the personal information we have on file about you. If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account. If your account settings do not allow you change the information yourself, please contact us and we will do our best to change the personal information for you.

Right to Delete Your Personal Information.

This is called the right to erasure, right to deletion, or the right to be forgotten. This right means you can ask for your personal information to be deleted. Sometimes we can delete your information, but other times it is not possible for either technical or legal reasons. If that is the case, we will consider if we can limit how we use it. We will also inform you of our reason for denying your deletion request.

Right to Ask Us to Limit How We Process Your Personal Information.

This is called the right to restrict processing. It is the right to ask us to only use or store your personal information for certain purposes. You have this right in certain instances, such as where you believe the data is inaccurate or the processing activity is unlawful.

Right to Ask Us to Stop Using Your Personal Information.

This is called the right to object. This is your right to tell us to stop using your personal information. You have this right where we rely on a legitimate interest of ours (or of a third party). You may also object at any time to the processing of your personal information for direct marketing purposes. We will stop processing the relevant personal information unless: (i) we have compelling legitimate grounds for the processing that override your interests, rights, or freedoms; or (ii) we need to continue processing your personal information to establish, exercise, or defend a legal claim.

Right to Move or Port Your Personal Information.

This is called the right to data portability. It is the right to ask for and receive a portable copy of your personal information that you have given us or that you have generated by using our services, so that you can:

  • Move it;
  • Copy it;
  • Keep it for yourself; or
  • Transfer it to another organization.

Right Related to Automated Decision Making.

We sometimes use computers to study your personal information. We might use this personal information so we know how you use our services. For decisions that may seriously impact you, you have the right not to be subject to automatic decision-making, including profiling. But in those cases, we will always explain to you when we might do this, why it is happening, and the effect.

Right to Withdraw Your Consent.

Where we rely on your consent as the legal basis for processing your personal information, you may withdraw your consent at any time. If you withdraw your consent, our use of your personal information before you withdraw is still lawful.

Right to Non-Discrimination.

We will not discriminate against you for exercising any of your privacy rights. Unless the applicable data protection laws permit it, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Your Right to Opt-Out of the Sale of Personal Information.

You have the right to ask us to not sell your personal information at any time, referred to as the right to opt out. You can request to opt-out of this “sale” of your personal information here: Do Not Sell My Personal Information.

Once you make an opt-out request, we will not ask you to reauthorize sale of your personal information for at least twelve months. However, if you change your mind, you may opt back into personal information sales at any time by using the contact details at the end of this Notice. We will only use personal information you provide us in an opt-out request to review and comply with the request.

Shine the Light.

Under California Civil Code section 1798.83, California residents are entitled to ask us for a notice identifying the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to us using the contact details below.  You must put the statement “Your California Privacy Rights” in your request and include your name, street address, city, state, and ZIP code. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

Right to Lodge a Complaint with a Supervisory Authority.

If the GDPR applies to our processing of your personal information, and you would like to submit a complaint about our use of your personal information or our response to your requests regarding your personal information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction. Specifically, you can lodge a complaint in the Member State of the EU of your habitual residence, place of work, or the alleged violation of the GDPR. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. We will only use the personal information you provide us in a request to verify your identity or authority to make the request.

Authorized Agents. If you are submitting a request on behalf of somebody else, we will need to verify your authority to act on behalf of that individual. When contacting us, please provide us with proof that the individual gave you signed permission to submit this request, a valid power of attorney on behalf of the individual, or proof of parental responsibility or legal guardianship. Alternatively, you may ask the individual to directly contact us by using the contact details above to verify their identity and confirm with us that they gave you permission to submit this request.

How and When We Will Respond to Your Rights Requests.

We will confirm the receipt of your request within ten (10) business days and, in that communication, we will also describe our identity verification process (if needed) and when you should expect a response, unless we have already granted or denied the request.

Please allow us up to a month to reply to your requests (except requests to stop selling your personal information) from the day we received your request. If we need more time (up to 90 days in total), we will inform you of the reason why and the extension period in writing.

We will act upon your request to opt-out from selling your personal information within fifteen (15) business days. We will also notify the third parties to whom we sold your personal information of your request and instruct them not to further sell your personal information. We will inform you about this in ninety (90) days from the receipt of your request.

If we cannot satisfy a request, we will explain why in our response. For data portability requests, we will choose a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without difficulty.

We will not charge a fee for processing or responding to your requests. However, we may charge a fee if we determine that your request is excessive, repetitive, or manifestly unfounded. In those cases, we will tell you why we made that determination and provide you with a cost estimate before completing your request.

How We Use Cookies and Other Tracking Technologies.

On our webpages, we may collect your personal information by using cookies, browser web storage (also known as locally stored objects, or “LSOs”), Flash-based LSOs (also known as “Flash cookies”), web beacons, and similar technologies, and our emails may also contain web beacons.

Opt-out of marketing communications.

You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at support@heynota.com. You may continue to receive service-related and other non-marketing emails.

Targeted online advertising.

Some of our business partners that collect information about your activities on or through the Site may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising.

You may opt out of receiving targeted advertising on websites from members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or Apple ID for Advertising associated with your mobile device.

If you choose to opt out of targeted advertisements, you will still see advertisements online, but they may not be relevant to you.

Third-party platforms or social media networks.

If you choose to connect to the Site via a third-party platform or social media network, you may have the ability to limit the information that we may obtain from the third-party at the time you connect your account. Subsequently, you may be able to control your settings through the third party’s platform or Site. For example, you may access and change your settings through the Facebook settings page for Apps and Websites. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third party.

Other Sites, Mobile Applications and Services.

The Site may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

Security Practices.

The security of your personal information is important to us. We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect.

Children.

The Site is not directed to, and we do not knowingly collect personal information from, anyone under the age of 16. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. Changes to this Privacy Notice.

We reserve the right to modify this Notice at any time. If we make material changes to this Notice, we will notify you by updating the date of this Notice and posting it on the Site.
